The reporter recently obtained information from well-informed sources that the Ministry of Commerce is currently working on developing supporting measures to implement the new automobile industry development policy. These measures include updates to the automobile trade policy, brand sales management guidelines, and rules governing the used car market. Notably, one of the proposed regulations suggests that the minimum distance between car dealerships should be set at 4 kilometers.
According to a source close to the matter, the Ministry recently held a meeting with key players in the automotive industry to discuss four key documents, including these new legal provisions. During the discussion, the regulation regarding the minimum distance between dealerships sparked significant debate among participants. The original version of the "Automobile Brand Sales Management Regulations" had set the minimum distance at 15 kilometers, but several manufacturers expressed concerns and advocated for a reduction to around 4 kilometers.
An industry expert told reporters that car dealerships typically operate under regional marketing models, which should be encouraged and supported. However, if a manufacturer insists on establishing a dealership within 4 kilometers of another, it could lead to market saturation and over-competition. This, in turn, may hinder the growth of specialty stores that currently have limited influence in product marketing.
The revised brand sales management approach has drawn considerable attention. It is also reported that the upcoming "Automobile Brand Sales Management Regulations" may include specific provisions on how domestic and imported vehicles will be handled under the new industry policy. The new rules could require that vehicle operators not only have the right to sell cars but also possess brand agency rights and operating licenses. Furthermore, each brand’s agency must function as an independent business entity.
Yu Jianhua, deputy director of the Department of Commerce, previously stated in an interview that many industry stakeholders are concerned about the end of the transition period next year and how the country will handle vehicle imports once quota permits are fully eliminated. He emphasized that the process is ongoing and that the government is committed to strictly following its WTO obligations. “We will cancel all non-tariff measures according to the scheduled timeline,†he said.
He added that the basic principle behind all management approaches is to align with four key requirements: 1) compliance with WTO regulations and procedures; 2) alignment with China’s Foreign Trade Law; 3) consideration of China’s current economic realities; and 4) adherence to common practices among other WTO members.
Yu believes that managing the import of automobiles and parts by referencing methods used by other WTO members is the direction China should take in the future. This approach aims to create a more transparent, competitive, and sustainable auto market.
